Wills & Probate
Wills
At Shelbournes Property Lawyers, we understand that planning for the future or dealing with the loss of a loved one can be overwhelming. Our probate and wills services are designed to provide clarity, compassion, and expert guidance to ensure your wishes are honoured and estates are managed efficiently.
Why Make a Will?
A Will ensures your assets are distributed according to your wishes, providing peace of mind for you and your loved ones. Without a Will, intestacy rules may dictate how your estate is divided, which may not align with your intentions. We draft clear, legally binding Wills tailored to your circumstances, including provisions for complex family structures, business assets, or charitable bequests.
We offer secure storage options to ensure your Will is safe and accessible when needed.
Basic wills be charged at £300.00 plus VAT.
More complicated Wills will be charged at an hourly rate of £250.00 plus VAT.
Probate
What is probate?
Probate is the legal process of administering a deceased person’s estate, including distributing assets and settling debts
Our Probate Services:
- Applying for a Grant of Probate or Letters of Administration.
- Valuing and managing the estate, including property sales or transfers.
- Settling debts, taxes (e.g., Inheritance Tax), and distributing assets to beneficiaries.
- Handling disputes or complex estates with sensitivity and expertise.
Probate Costs
Many factors impact fees of dealing with the administration of an estate, some of which are (but not limited to):
- Value of estate
- Oversea assets
- Type assets (property or shares etc.)
We provide estimate of costs on a case-by-case basis. Once we have all the information about an estate, we will be able to provide a quote.
Smaller estates will be charged at an hourly rate of £250.00 plus VAT. Larger estates will be charged at 1% or 2% of the total value of the estate plus VAT. E.g. £1,000,000.00 would cost £10,000.00 plus VAT at 2,000.00. Total = £12,000.00.
Where there are properties within the estate we will have to charge further fees on top. If a property is being sold on the open market then please go to the conveyancing tab to see our fees estimates. If the property is being assented (given) to a beneficiary then these will usually be cheaper than our conveyancing fees estimates, and we will provide you with a quote once we have seen the Will.
Lasting Powers of Attorney (LPA)
We assist with setting up LPAs, allowing you to appoint trusted individuals to make decisions on your behalf if you lose capacity. We offer both Property and Financial Affairs LPAs and Health and Welfare LPAs.
This will be charged at an hourly rate, please call to discuss further.
Trusts
We advise on setting up trusts to protect assets, minimise tax liabilities, or provide for future generations. Whether it’s a discretionary trust or a trust for a vulnerable beneficiary, we tailor solutions to your needs.
This will be charged at an hourly rate, please call to discuss further.
